How much of your income is already spoken for?

Add up every monthly repayment you make — EMIs, credit card minimums, anything on instalments — and compare it with what actually reaches your account each month. Lenders run the same sum before they approve anything, and so do we before we take a case on.

Above forty per cent, most lenders stop approving new credit, and one missed month starts a chain reaction.

Know your rights

What a lender and its agents may not do

Being behind on a loan does not remove your rights. The Reserve Bank of India's fair-practices requirements bind the lender and everyone it outsources recovery to. These are the four points people most often do not know.

  • Recovery calls have hours

    Contact for recovery is restricted to reasonable hours — the RBI's directions to lenders put it between 8 a.m. and 7 p.m. Calls at midnight, or at five in the morning, are not something you have to accept.

  • Your family and your employer are not the debtor

    Agents may not humiliate you, threaten you, or take the matter to your relatives, neighbours or your workplace to create pressure. The obligation is yours alone, and it is a civil one.

  • Every settlement must be in writing

    A figure agreed on a call is worth nothing. Ask for the settlement letter on the lender's letterhead, with the account number and the deadline, and pay only against it — then collect the no-dues certificate.

  • There is a complaint route above the lender

    Each bank and NBFC has a grievance officer and a published escalation path, and above them sits the RBI Ombudsman scheme. A complaint costs nothing to file.

The words that appear in the letters

Eight terms that turn up in lender correspondence and in conversations about settlement, without the jargon around them.

One-time settlement (OTS)

A written agreement in which the lender accepts a reduced lump sum in full and final settlement of the account, and closes it.

NPA — non-performing asset

How a lender classifies an account once it has been overdue for around ninety days. It is the point at which settlement normally becomes possible at all.

Settlement letter

The lender's own letter stating the reduced figure, the account it applies to and the date by which it must be paid. Nothing is settled without it.

No-dues certificate (NOC)

The document issued after payment confirming nothing further is owed. Keep it — it is what ends the matter years later if anyone asks.

Restructuring

Changing the terms rather than the amount: a longer tenure, a smaller monthly payment, sometimes a short relief period. Used when the account is still being serviced.

Credit report status

An account can be reported as “closed”, “settled” or “written off”. Settlement produces the middle one, and it stays visible on the report for years.

Secured and unsecured

Secured debt is backed by an asset the lender can take — a home, a vehicle. Unsecured debt is not, which is why lenders concede more on cards and personal loans.

Grievance redressal

The formal complaint route inside a bank or NBFC, ending at the RBI Ombudsman. It exists for recovery conduct as much as for service failures.
